These terms of use apply to the use of the Aistin service.
1. Service provider
The Aistin service is provided by:

In its Aistin business, SMUW AI Oy also uses the registered auxiliary business name Albert Aistin.

In these terms, the service is referred to as Aistin and the service provider as SMUW AI Oy or the service provider.
The user of the service and the customer are referred to as the user or the customer.
2. Acceptance of the terms
By using the Aistin website, application or other Aistin services, you accept these terms of use.
If you use Aistin on behalf of a company or other organisation, you confirm that you are authorised to bind that organisation to these terms.
Aistin is intended primarily for use by companies and other organisations.
The service may only be used in accordance with these terms and applicable law.
3. User account
When creating an account, the user must provide accurate and sufficient information.
The user is responsible for:
the security of their own login credentials
activity that takes place in their user account
ensuring that credentials are not shared without authorisation with other people.
An organisation's administrator can manage the organisation's users and access rights.
If the user suspects that their account or credentials have fallen into the hands of a third party, they must notify us without delay.
4. The Aistin service
Aistin is a software service for managing a company's work, information, customer relationships, communication and business.
The service may include, for example:
CRM features
documents
website tools
calendar features
email features
automations
integrations with external services
AI-based features.
The features of the service may depend on the customer's subscription, the user's role and the integrations in use.
5. Albert and AI features
Aistin may use the Albert AI assistant and other AI-based features.
The AI may, for example:
analyse the customer's material
summarise information
create drafts
suggest actions
help with finding information
prepare messages, quotes or other content
run automations the user has enabled.
Content produced by AI may be inaccurate, incomplete or otherwise unsuitable for its intended purpose.
The user is responsible for reviewing AI-generated content before using it in material decisions or external communication.
Unless a particular feature has been specifically defined as automatic, the user decides which of Albert's suggestions are used.
Aistin's AI features may be delivered with the help of one or more external AI service providers.
6. External services and integrations
At the user's choice, Aistin can be connected to external services such as:
Google services
Microsoft services
email services
calendar services
payment services
other third-party services.
The user decides which integrations they enable.
Using an integration may require the user's separate consent and acceptance of the third party's terms.
SMUW AI Oy is not responsible for a third-party service's:
availability
changes
outages
discontinuation
operation that we cannot reasonably influence.
If a third party changes or discontinues an API or other service, the related Aistin feature may change or stop working.
7. Customer content
The customer retains ownership of the content it adds to Aistin.
Such content may include, for example:
documents
CRM data
images
website content
emails
notes
calendar data
instructions the user gives to the AI.
The customer grants SMUW AI Oy the right to process the content to the extent necessary:
to provide the service
to carry out actions requested by the user
to store and transfer the content
to maintain the security of the service
to investigate technical problems.
This right does not transfer ownership of the content to SMUW AI Oy.
Aistin does not use the customer's private content to train general-purpose AI models.
8. Customer's responsibility for content
The customer is responsible for ensuring that:
it has the right to store the content in Aistin
the content is processed lawfully
the necessary consents and other legal bases for processing are in place
the content does not infringe the intellectual property or other rights of any third party.
In particular, the customer must ensure that the processing of personal data brought into Aistin complies with data protection legislation.
9. Personal data
The processing of personal data in Aistin is described in more detail in the Aistin privacy policy:
https://www.aistin.ai/en/privacy-policy
When SMUW AI Oy processes personal data on behalf of the customer as a data processor, a separate data processing agreement applies to the processing where required.
10. Acceptable use
Aistin may not be used:
for unlawful activity
to infringe the rights of others
to spread malware or other harmful content
to circumvent the security of the service
to gain unauthorised access
to place an unreasonable load on Aistin's infrastructure
to send spam or other unlawful communications
to impersonate another person in a misleading way
to process content the user does not have the appropriate rights to.
The user must also comply with the terms and usage policies of external services connected to Aistin.
11. Subscriptions and prices
Aistin may offer free and paid service levels.
For a paid subscription, the:
price
billing period
features
number of users
any usage limits
are determined by the price list in effect at the time of ordering or by the offer made to the customer.
A monthly or annual subscription renews automatically unless it is cancelled before the start of the next billing period.
Depending on the features of the service, the customer can:
add or remove user licences
change service level
end their subscription.
Fees already paid are not refunded, and no credit is given for a partial billing period, unless mandatory law requires otherwise.
12. Price changes
We may change the prices of the service.
Reasonable advance notice will be given of any price change that materially affects an existing paid subscription.
A price change normally takes effect no earlier than the start of the next billing period.
13. Changes to the service
Aistin is constantly evolving.
We may:
add features
change features
replace technical solutions
change the user interface
remove features.
If we remove or materially change a key feature of a customer's paid service, we aim to give notice of the change in advance where reasonably possible.
14. Availability of the service
We aim to keep Aistin reliably available, but we do not guarantee uninterrupted or error-free operation.
The service may experience outages due to, for example:
maintenance work
software bugs
infrastructure problems
security measures
disruptions in external services.
We may carry out urgent maintenance or security measures without prior notice.
15. Suspension of the service
We may temporarily restrict or suspend a user's access to the service for a justified reason.
Such a reason may be, for example:
a material breach of these terms
failure to pay
a security risk
unlawful use
harm to the service or other users
a requirement of an authority or of law.
If immediate suspension is not necessary, we aim to give advance notice and allow the customer a reasonable opportunity to remedy the breach.
16. Ending a subscription
The customer can end its subscription through the self-service or customer service channels available at the time.
Cancellation normally takes effect at the end of the current paid billing period.
After that, the user's right to use paid features ends, or the service may move to a free service level if one is available.
The customer should export any data it needs from the service before the account is permanently deleted.
17. Intellectual property rights
The following relating to the Aistin service:
software
source code
user interface
structure of the service
the Aistin brand
the Albert character
logos
documentation
other material owned by SMUW AI Oy
are the property of SMUW AI Oy or its licensors.
Under these terms, the user is granted only the limited right of use necessary to use the service.
Ownership of the content the customer adds to Aistin remains with the customer.
18. Confidentiality
We treat non-public business information that the customer stores in Aistin as confidential.
We may give our employees and service providers access to it only to the extent required for providing the service, security, customer support or statutory obligations.
19. Limitations of the service and AI
Aistin and Albert should not be regarded as independent legal, medical, accounting, tax or other professional advice.
Material produced with the service should be assessed with the care its intended use requires.
The user is ultimately responsible for the business decisions they make with the help of the service and for content sent out from the service.
20. Disclaimer of warranties
The service is provided as available at any given time.
To the extent permitted by mandatory law, we give no warranty that:
the service meets all of the user's specific needs
the service always operates without interruption
all errors can be corrected
AI-generated content is always correct or complete.
21. Limitation of liability
To the extent permitted by mandatory law, SMUW AI Oy is not liable for indirect or consequential damages, such as:
loss of profit
loss of revenue
business interruption
indirect loss of data
other consequential loss.
SMUW AI Oy's total liability for claims relating to the service is limited to the greater of:
EUR 1,000, or
the fees the customer paid for Aistin during the 12 months preceding the event giving rise to the claim.
The limitations of liability do not apply to the extent that liability cannot be limited by law.
22. Backups
Although Aistin uses technical backups to support continuity of the service, the customer must ensure appropriate backups of material critical to its business.
Technical backups are not intended as the customer's own archiving service.
23. Force majeure
SMUW AI Oy is not liable for delay or damage caused by an event beyond our reasonable control.
Such an event may be, for example:
a widespread telecommunications or power outage
a serious disruption of a cloud service
a natural disaster
war or action by an authority
a strike
another comparable force majeure event.
24. Consumer rights
Aistin is intended primarily for use by companies and organisations.
If a user nevertheless uses the service as a consumer, nothing in these terms limits the rights a consumer has under mandatory law.
For example, a consumer may have rights of withdrawal relating to distance selling under applicable law.
25. Changes to the terms of use
We may update these terms of use.
If a change materially affects an existing customer's rights or obligations, we will give reasonable advance notice of the change.
The current terms of use are available at:
https://www.aistin.ai/en/terms-of-use
26. Governing law and disputes
These terms of use are governed by the laws of Finland.
Any disputes with business customers will primarily be resolved through negotiation.
If the matter cannot be resolved through negotiation, the dispute will be settled in a competent Finnish court.
Consumers are subject to their mandatory statutory rights and rules on jurisdiction.
27. Severability
If any provision of these terms is found invalid or unenforceable, the remaining terms remain in force.
28. Entire agreement
These terms of use, the privacy policy and any separate written agreement made with the customer together form the agreement concerning the Aistin service.
If a separate agreement made with the customer contains terms that differ from these terms of use, the terms of the separate agreement prevail in the event of a conflict.
